1. General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you") with Grazalema Cycling Adventures, owned by Agnieta Francke, Y4579251B, (hereinafter referred to as “Grazalema Cycling Adventures”, "we" or "ours") ,at the Grazalema Cycling Adventures website or mobile website (jointly referred to as “grazalemacycling.com”).

By using grazalemacycling.com and/or placing an order, you agree to be bound by the terms and conditions as set out herein (the "Terms"). Please make sure you have read and understood the Terms before placing your order.

Only persons of 18 years of older, who are not under guardianship and who are not acting in a capacity of a company can place an order. We send our products to delivery addresses in Spain, Germany, Andorra, Austria, Belgium, Denmark, France, Gibraltar, Greece, Bailiwick of Guernsey, Ireland, Italy, Bailiwick of Jersey, Isle of Man, Azores, Falkland Islands, Luxembourg, Madeira, Monaco, Norway, Netherlands, Portugal, United Kingdom, San Marino, Sweden, Switzerland or Vatican. The information you provide us must be accurate and complete. If you would like to receive a product in a country that is not mentioned here, please contact us by sending an email to info@grazalemacycling.com before placing an order.

The inclusion of any products or services on grazalemacycling.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product or service at any time. We try to ensure that the information on grazalemacycling.com is complete, accurate, and up to date. Despite our efforts, this may not always be the case. Please note that we have no obligation to maintain or update any information. You should not rely on such information, and any reliance on it will be your responsibility.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will be applied to your order will be the one that is published on grazalemacycling.com at the time of placing your order.

Grazalema Cycling Adventures wants to provide the best possible online experience. To make this possible, we need to ensure that pour services run like a clockwork. You understand and agree not to

  • post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services;
  • act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the grazalemacycling.com site, or which impacts the security of the site, or
  • employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

2. Prices and Delivery Charges

The prices displayed at grazalemacycling.com include the statutory Value Added Tax (VAT), but do not include a delivery charge.

The delivery charge for each order will depend on the delivery address and the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in our physical store may vary from those online.


3. Ordering/Conclusion of Contract

The ordering options available to you are via grazalemacycling.com, email or telephone. Please, contact us to obtain more information.

Once you have placed your order, you will receive an email confirmation. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we refund the applicable amount by bank transfer. In this case, we will contact you to settle the refund.


4. Delivery

Grazalema Cycling Adventures exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to the address you provide us with in Spain, Germany, Andorra, Austria, Belgium, Denmark, France, Gibraltar, Greece, Bailiwick of Guernsey, Ireland, Italy, Bailiwick of Jersey, Isle of Man, Azores, Falkland Islands, Luxembourg, Madeira, Monaco, Norway, Netherlands, Portugal, United Kingdom, San Marino, Sweden, Switzerland or Vatican. If you would like to receive a product in a country that is not mentioned here, please contact us by sending an email to info@grazalemacycling.com before placing an order.

Grazalema Cycling Adventures endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. We aim to deliver within 2 to 4 business days for deliveries in Spain and 4-10 business days for deliveries to the rest of Europe following confirmation of an order, unless otherwise agreed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

Before you place your order, you will be informed of the expected delivery details. Once you have placed your order, you will receive an email confirmation with your expected delivery details. If your order does not arrive within the scheduled time frame, please contact us.

5. Withdrawal of Order

You may cancel or return your order from the date you place the order until 30 days after receipt of the ordered items. If you have been charged for the items, you will receive a refund which will not include Grazalema Cycling Adventure´s standard delivery costs, nor will the refund include the costs of sending the item(s) back to us.

If you wish to cancel or return your order, please provide us with notice in writing by sending us an email or filling in and submitting the contact form on our website with subject “Cancellation order”, indicating your order number or including a copy of your receipt or invoice, and stating which item(s) you would like to return. Return the item(s) to us as set out in section 6 (Returns) below within the 30-day period set forth in section 5.1 above. We will provide a refund by bank transfer (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your notice cancellation, provided we have received the items or evidence of you having sent back the items. The return package must contain the account number to which the refund will be made (IBAN and BIC or SWIFT). Another payment method may be used for the refund, provided that you consent to such change, in any case this will not generate any additional charges.

If the item you have received is defective, please notify Grazalema Cycling Adventures within 48 hours and return the item in accordance with section 6 (Returns) below. Grazalema Cycling Adventures will, for any products deemed defective, provide a full refund, including the shipping costs.

If the package arrives in poor condition, make a note of it on the carrier’s delivery note before (s)he leaves. This will enable the agent’s insurance to cover possible damages caused to the order. Keep the items that have arrived in poor condition in case the shipping agent arrives to collect them.

The provisions set forth herein do not limit any applicable statutory rights.


6. Returns

Grazalema Cycling Adventures guarantees a refund of the returned items, except shipping charges, in accordance with section 5 (Withdrawal of Order), provided that the following conditions are met:

  1. You must have sent us an email or a message using our contact form previously with the subject “Cancellation order”.
  2. All items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.
  3. The product must be returned with their original packaging and receipt or invoice.

Send the item(s) that you want to return to our address, Calle Doctor Mateos Gago 9, 11610 Grazalema, Cádiz, Spain. You can also bring the item(s) you wish to return to our store in the centre of Grazalema. Grazalema Cycling Adventures will never accept returns sent by postage due / against reimbursement.

You will be refunded by bank transfer. Therefore, the return package must contain the account number to which the refund will be made (IBAN and BIC or SWIFT).

We will only refund the charges of the return shipping when the item is defective or when there has been an error in the shipment. In these cases, and after checking that one of these cases is proven, we will reimburse the full amount paid, including the original shipping and return shipping charges.

Faulty or defective items may also be returned to our store.


7. Payment Methods

You can pay for your goods in various ways as set out below.

Credit or Debit Card
Grazalema Cycling Adventures uses a secure Payment Gateway provided by Caixa Bank (TPV Redsys). Payment is made through an independent website that accepts a wide variety of credit and debit cards. When making a payment through the gateway, the user is directly connected to the bank´s website. Purchases that are made via the payment gateway are made securely by means of SSL protocol. With this protocol, all of your financial data is encrypted and cannot be seen by anybody except you.

The applicable amount will immediately be debited on your card. Grazalema Cycling Adventures reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

Payment by Bank Transfer
Orders not paid within 72 hours will be cancelled. You can reactivate them from your account.

PayPal
When paying by PayPal, Grazalema Cycling Adventures reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be debited on your PayPal account. Grazalema Cycling Adventures reserves the right to deny any purchase.

Invoice
An automated order receipt is generated with every purchase, which is drawn up using the data provided by the customer. If you require an invoice, please send an email to info@grazalemacycling.com indicating your order number and the tax information required to generate the invoice.


8. Our Liability

Our maximum liability to you for any loss or damage arising in connection with your order on grazalemacycling.com shall be limited to the total price of your order.

Notwithstanding the foregoing, our liability is not excluded or limited in the following cases:

  • In the event of death or personal injury caused by our negligence;
  • In case of fraud or fraudulent misrepresentation; or
  • In any matter where it is illegal or unlawful for us to exclude, limit or attempt to exclude or limit our liability.

Grazalema Cycling Adventures is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Nothing in these Terms shall exclude or limit Grazalema Cycling Adventure´s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

If you have a problem with a product that you have purchased from grazalemacycling.com, and were not able to settle the complaint with Grazalema Cycling Adventures, then you can submit your complaint to the EU’s online dispute resolution platform (the “ODR platform”).

The ODR platform offers consumers and traders within the EU with the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. This single-entry point is designed to be a user-friendly and interactive website, available in all EU official languages and free of charge. Using the ODR platform the consumer and the trader can find a dispute resolution body and then go through the process of finding a solution to the consumer’s complaint. 9. Colours and Measurements

We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

An item’s measurements given on grazalemacycling.com are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.


10. Guarantee

If there are defects in the goods you have purchased, Grazalema Cycling Adventures abides by all statutory guarantee regulations. Please make sure to keep the order receipt, as its presentation is necessary for verifications, changes and/or returns.

Unless proven otherwise, it will be understood that the products are in accordance with the contract, provided that they meet all the requirements expressed below:

  • They meet the description that has been provided by Grazalema Cycling Adventures and have the qualities of the product that we have presented to you.
  • Are suitable for the use for which products of the same type are normally used.
  • They present the usual quality and performance of a product of the same type that you can basically expect, considering the nature of the product.

Deficiencies caused by negligence and misuse are not included.

If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know within 48 hours by email (info@grazalemacycling.com) or by using the contact form on our website with subject “Guarantee”, indicating your order number or including a copy of your receipt or invoice.

In those occasions that justify the use of the guarantee, we will opt to repair or replace the item, offer a discount or provide a refund, all according to the legally established terms.


11. Assignment

Grazalema Cycling Adventures reserves the right to assign or pledge to third parties any claim(s) for payment including any payment instalments which have arisen in connection with the delivery of goods.


12. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.


13. Ownership of Rights

All intellectual property rights, such as trademarks and copyrights at grazalemacycling.com remain with Grazalema Cycling Adventures, property of and led by Agnieta Francke, and its subsidiaries or licensors. Any use of grazalemacycling.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Grazalema Cycling Adventures.
